9:15 AM – 10:15 AM – General Session – “Managing Risks of Scene Hazards after Large Losses”.

There have been recent developments in which the property insurers have been exposed to significant liabilities to which they were not exposed before.

They have recently even been exposed to liability associated with the safety of their own experts at the loss site! This topic should be of interest to not only the property insurers, but also to those employed to assist in site and loss assessment.

This session will be chaired by Mamoon Alyah, PE, Director of Forensic & Engineering Services, LWG Consulting. He will be joined by Russell D. Melton, Esq., Partner in Meagher & Geer, LLP, Minneapolis, MN; and a company representative to be named.

10:45 AM – 11:45 AM – General Session – “The Impact of an Insured’s Post-Loss Foreclosure or Bankruptcy”.

A negative change in the insured’s financial status after a claim has serious repercussions on its resolution, particularly a foreclosure or a bankruptcy. Other parties, whose interests in receiving payment often compete directly with the insured’s interest in repairing the property as quickly as possible, can acquire a voice, involve other courts and procedures thereby altering and delaying the outcome of the claim. This stresses the interpretation of several key policy provisions, particularly the definition of Period of Interruption, and adds more equitable considerations for a court to consider when making a decision of coverage.


The presentation will be chaired by Nicholas A. Pasciullo, Esq., Director of Complex Property and Energy, The Chartwell Law Offices, LLP, Pittsburgh, PA. He will be joined by Peter Karutz, CPA, Matson, Driscoll & Damico, St. Louis, MO; Mathew Gonzalez, Esq., also of the Chartwell Law Firm, and a company representative to be named..

1:30 PM – 4:45 P.M. – Four concurrent workshops (all registrants). Four workshops are offered. Please attend the workshop that you designated on your workshop registration form and which is included in your meeting envelope.


Workshop # 1 – “LEEDing Issues in Green Building Loss Adjustments”.

What do you know about “Green” Buildings? Green building coverages and claims are here. This workshop will be an interactive program to help you through the adjustment and provide what every adjuster needs to know about LEED (Leadership in Energy and Environmental Design). It will include discussions on the impact of codes and ordinances on green building claims.

The workshop will be chaired by James Whipple, Executive General Adjuster, Crawford Technical Services, Los Angeles, CA. He will be joined by David E. Bocan, Esq. and Amy Churan, Esq., both partners of Robins, Kaplan, Miller & Ciresi, LLP., Los Angeles, CA. Also on the panel will be Roy Juede, CPA, Hagen Streiff Newton & Oshiro, Los Angeles, CA and Laura Connelly, RPA, Executive General Adjuster, Allianz Global Corporate & Specialty, Burbank, CA.


Workshop # 2 – “Managing Resources Effectively to Balance Competing Interests Following Large Losses: Speedy Cleanup vs. Careful Preservation”.

Following large losses, different competing interests present themselves. What is more important, speedy cleanup to return the insured to pre-loss condition and minimize business interruption or careful preservation to investigate subrogation and maximize recovery? These are some of the issues contemplated by claim professionals following catastrophic losses. These and other challenges are overcome by effective management of resources working on the scene. This workshop examines real-life case studies and provides practical solutions to consider.

This workshop will be chaired by Mamoon Alyah, PE, Director of Forensic & Engineering Services, LWG Consulting, Chicago, IL. He will be joined by Martin C. Sener, Esq., partner in Clausen Miller, LLP, Chicago, IL and Dennis M. Corrigan, Executive General Adjuster, FM Global, Park Ridge, IL.


Workshop # 3 “Burning the Candle at both Ends: A Guide to Settling Claims while Preserving your Reinsurance Coverage”.

You have a complex $30M claim and an aggressive insured who is coming up with some pretty creative coverage arguments. The loss spans two policy periods and will have to be allocated. The insured’s reporting was not as prompt as you would have liked. But the insured is a good account and the underwriters ask you to make reasonable allowances due to the devastating nature of this particular loss. Meanwhile, the Vice President of Claims tells you that the account is 80% reinsured and every step must be taken to avoid a reinsurance dispute. The reinsurer assigns a claims examiner who is asking a lot of questions.

This workshop will review the traps and pitfalls of such situations and provide best practices for managing the claim, reporting to all interested parties, cooperating with the reinsurer, resolving disputes and recovering from the reinsurer while preserving confidentiality and your position in the company.

The workshop will be chaired by William N. Erickson, Esq., Robins, Kaplan Miller & Ciresi, L.L.P., Boston, MA. He will be joined on the panel by Edward Ryan, Vice President, Munich Re America, Princeton, NJ; Nancy Sue Stein, Vice President, GenRe, Stamford, CT; Kevin L. Ennis, Vice President & Claims Manager, America’s Specialty and Marine Swiss Reinsurance Corp., Armonk, NY and (hopefully an underwriter from the London market).


Workshop # 4 – “Boiler & Machinery vs. All Risk”.

The dividing line between All Risk and Boiler & Machinery coverages continues to cause adjusting problems. These problems will be explored in a workshop format that will cover the dividing line between the coverages for the peril of explosion. In addition, this workshop will explore the difficulties that arise when an upfront insurer covers both perils but then reinsures only the Boiler & Machinery peril. The workshop will discuss real life practice tips, important engineering concepts, as well as underwriting insights and existing case law.

This workshop will be chaired by Mark Bruckmann, Esq., Bruckmann & Victory, L.L.P., New York City. He will be joined on the panel by Steven Perkins, Claims Manager, Equipment Breakdown, Liberty Mutual Property, Weston, MA; Will Cassidy, PE, Douglas G. Peterson Associates, Greenfield, MA; and (hopefully) Luis Prato, a Lloyd’s energy underwriter, Catlin Syndicate, London, England.


(Afternoon refreshments of coffee, tea, soda and water will be available in the Foyer area from 2:45 – 3:15 PM. Workshops should take a 15 minute break when appropriate to their discussions but within those time frames). (Provided by the LEA).
